Abstract

The evolution of patent laws highlights the effect that the political, economical and even scientific regulations – which mainly come from a supranational level – have had on the object – in the real sense, technical, as in the figurative sense, as a purpose – of a legal regime built to allow the peaceful marketing of inventions of interest by the legislators of the late 18th century. The patent system, analyzed here through the traces that innovation, a functional tool of the observed regulations, left on its object, shows today, in its practice, some new power relationships that can be perceived as risks to the economic and social well-being of the countries that promoted it.

Introduction. L’outil brevet

Plusieurs questionnements peuvent être élaborés à partir de la problématique des nouveaux objets du droit des brevets et de ses liens avec la question des échelles des régulations.

Le premier, classique pour la science juridique, consiste à interroger la pertinence et la portée d’une des conditions clés de la brevetabilité : la nouveauté1, sa fonction et ses carences, son application pratique.

Le deuxième, plus ouvert aux raisonnements externes au droit, prend appui sur l’apparition dans le champ des brevets, de nouvelles catégories d’objets pour lesquels ce droit n’a pas été pensé au départ. L’histoire récente du droit des brevets d’invention ne manque pas d’exemples en ce sens. Qu’il s’agisse du domaine des biotechnologies2, des logiciels3, ou encore des méthodes commerciales4, la littérature fait état de leur apparition dans le domaine de la brevetabilité5 et des contestations qu’elle soulève.
