Jeremy Bentham (1748-1832). L'homme et l'œuvre.

1Jeremy Bentham naît à Houndsditch dans la banlieue de Londres, le 15 février 1748, et décède dans la capitale anglaise quatre-vingt-cinq ans plus tard, le 6 juin 1832. Il chevauche ainsi les deux siècles, le dix-huitième, qui a vu l'écrivain sacralisé par le prince "éclairé" et le dix-neuvième, qui assure le triomphe de l'opinion publique. Au premier, Bentham donne les gages de sa réflexion fondamentale sur l'organisation de la société et de l'insistance qu'il mettra à se faire entendre des "grands" de ce monde, souverains absolus d'États ou d'empires, gouvernants de régimes parlementaires ou membres d'assemblées révolutionnaires. Il anticipe le second en accordant nombre de ses écrits à la presse, utilisant parallèlement - ce qui était moins novateur - le pamphlet et la lettre ouverte comme moyens d'expression de sa pensée.

2Cette pensée dépasse sa personne et son temps, car Bentham est généralement reconnu aujourd'hui comme le père de l'utilitarisme moderne, ce qui est à la fois lui rendre justice et lui faire trop d'honneur. Il participe, en effet, à tout un mouvement d'idées qui fait se partager, aux XVIIIe et XIXe siècles, l'Europe continentale, fidèle aux principes de l'École du droit naturel et le monde anglo-saxon, rénovateur et progressiste, où se manifeste un détachement à l'égard des réminiscences jusnaturalistes.

3Bentham est l'un des jalons de cette évolution. Sa position est cependant particulière, en raison à la fois de sa personnalité et de son comportement originaux, mais aussi la manière dont s'est exprimée sa pensée.

4L'approche de celle-ci ne peut, en effet, être dégagée de considérations critiques, d'attribution notamment, que suscite la mise en concordance de la biographie du personnage et de l'élaboration de son œuvre ou de sa bibliographie.

5Tout en Bentham est et restera ambigu. D'une part, il a publié, de son vivant, peu d'œuvres achevées, mais, d'autre part, aussi prompt à la réflexion que laborieux à l'écriture, il laisse une masse considérable d'esquisses, de manuscrits les plus divers, conservés à la bibliothèque de l'University College de Londres, au British Museum et à la London School of Economics. Dans ces manuscrits, le plus souvent des brouillons, voire de simples bouts de papier couverts d'une écriture peu lisible et elle-même dès lors sujette aux interprétations divergentes1, il transcrit des idées a l'intention de disciples ou de futurs disciples, auxquels il laisse le soin, selon sa volonté expressément formulée, d'en établir la synthèse.

6Cette synthèse, d'ailleurs, est déjà tentée du vivant de Bentham, ce qui ajoute à la confusion du critique soucieux de distinguer la part originale du philosophe et celle du compilateur. C'est que le disciple en question, lui aussi, était homme de génie : Etienne Dumont, professeur de droit à l'Université de Genève2 et l'auteur d'une édition des Œuvres complètes de Bentham en 1829, non seulement publia cette compilation en français à partir d'originaux manuscrits anglais, mais en outre, ajouta à l'impression laborieuse de la pensée du philosophe anglais, la clarté du style et la clairvoyance de l'analyse. La qualité de celle-ci est souvent plus tributaire de Dumont que de Bentham !

7Mieux ou pire ! L'édition Bowring des Oeuvres complètes, publiée à Edimbourg entre 1838 et 1843, en anglais cette fois, est établie, pour une bonne part, non pas sur les originaux de Bentham, mais à partir de la traduction de l'édition Dumont ! La pensée du fondateur de l'utilitarisme est ainsi connue et diffusée au travers d'un triple enchaînement de copistes et d'interprètes : la compilation - (trop) brillante (peut-être) de Dumont, son expression en français par celui-ci et son retour à la langue de l'auteur originel, via l'édition Bowring et ses multiples répétiteurs ultérieurs...

8Bentham lui-même, en effet, publie fort peu d'œuvres d'envergure, en dehors des articles qu'il envoie aux journaux de son temps, - des adresses, aussi qu'en philosophe et écrivain "éclairé", il expédie à travers le monde aux gouvernements de pays en mutation.

9Maîtres - ès - arts de l'Université d'Oxford à dix-neuf ans, fils d'un avocat de renom et fortuné, ce qui le dégagera de tout souci d'argent, Bentham, après avoir étudié le droit, ne pratiqua guère le Barreau. Dès ses vingt-et-un ans, il se lance dans l'étude des réformes à appliquer aux modes de gouvernement et à la procédure judiciaire, apportant à cette démarche l'ouverture d'esprit interdisciplinaire qu'il manifesta toute sa vie durant et cela, dès son adolescence. Il lui donne aussi une dimension planétaire : "Citoyen de l'univers dans toute la force de l'expression, Bentham n'a laissé échapper aucune occasion d'être utile à ses semblables, à quelque nation qu'ils appartinssent". Cette remarque faite par un contemporain, belge d'origine et doyen de la Faculté de droit de Paris, Hyacinthe Blondeau3, situe bien le philosophe et réformateur anglais dans le contexte général du "sacre" de l'écrivain, qui caractérise la fin du XVIIIème siècle et le début du XIXème4. De ce point de vue, Bentham se montre cependant davantage héritier de l'Ancien Régime que du nouveau, s'adressant aux gouvernants plutôt qu'à l'opinion publique.

10A vingt-huit ans, en 1776, il publie son premier grand traité, incomplet comme l'indique son titre : A Fragment on Government, qui n'est qu'un extrait d'une polémique publique lancée, deux ans plus tôt, avec Blackstone5. Ce texte, anonyme, causa quelque sensation dans le monde officiel anglais et, lorsque l'identité de l'auteur fut dévoilée, eut pour effet de faire connaître Bentham à l'intelligentsia britannique6.

11De 1772 à 1789, il travaille à la rédaction de ce qui peut être considéré comme son œuvre principale, l'Introduction to the Principles of Morals and Legislation, publiée en 1789, mais sans le Code de droit criminel qui devait en être le complément indispensable.

12Dès avant cette publication cependant, Bentham s'empresse d'en faire traduire des passages en allemand, à l'intention de Catherine II, dont il attend de l'esprit "éclairé" l'adoption de ses principes et leur application en Russie.

13En novembre 1788, lorsqu'il apprend la réunion des États généraux en France, il s'empresse d'adresser une Lettre ouverte à Mirabeau, puis des Observations sur un arrêté de la noblesse de Bretagne, à l'occasion desquelles il rencontre Etienne Dumont. Celui-ci devient dorénavant l'interprète et le traducteur de la pensée de Bentham auprès du public francophone.

14Lorsque la Révolution française éclate, Bentham redouble d'ingéniosité. De 1789 à 1793, il cherche à influencer, à "éclairer" les divers gouvernements français dans leur choix d'un nouveau système d'organisation du pouvoir, de l'administration et de la procédure. Ses idées ne sont pas retenues telles quelles, mais ses textes ne passent pas davantage inaperçus. En 1792, Bentham est fait... citoyen d'honneur de la République française !

15Entretemps cependant, s'est produit un événement considérable dans l'évolution intellectuelle du moraliste anglais. Le 6 août 1785, il s'est embarqué à Brighton pour rendre visite à son frère Samuel, résidant à Krichëv, petite bourgade de Biélorussie, au sud de Smolensk. Son frère y exerce à la fois des activités d'entrepreneur et des fonctions élevées dans l'armée tsariste7. Ce voyage durera deux ans et demi. Jeremy Bentham est de retour à Londres, début février 1788, pour fêter ses quarante ans.

16Véritable expédition, ce périple le mène dans une sorte de tour d'Europe, empruntant routes et voies navigables pour se rendre à Marseille, via Dieppe, Paris, Châlons, Lyon et Montpellier ; utilisant une felouque de Marseille à Gênes par Nice, puis des malles-postes pour visiter Florence et Pise, un paquebot - le Marie-France - de Gênes à Smyrne, où il embarque à bord d'un caboteur chargé de marchands d'esclaves et d'esclaves noires !

17Il atteint ainsi Constantinople, d'où c'est à cheval et par de mauvaises routes, qu'il traverse la Bulgarie, rejoint Bucarest et remonte vers la Pologne. Il franchit le Dniester à Soroki en Moldavie, traverse la Podolie, partie de l'Ukraine, à l'époque polonaise, et atteint la frontière russo-polonaise à Bohopol, près de Balta, au sud de Kiev. Il arrive à Kirchëv le 10 février 1786, après six mois de route. Son retour sera plus bref et empruntera un itinéraire plus direct : Varsovie, Berlin, La Haye, Londres.

18Le séjour de plus d'un an que Jeremy Bentham effectue en Russie - de février 1786 à novembre 1787 - l'influence profondément et oriente pour longtemps son activité ultérieure. Ne voyageant guère, cloîtré dans la résidence campagnarde de son frère, il a cependant l'occasion de voir fonctionner un nouveau système de surveillance des ouvriers mis au point par Samuel Bentham. Il le transfère dans le domaine juridique et en fait la base de son projet de nouvelle organisation pénitentiaire, le Panoptique.

19Dès lors, et pendant des années, Jérémie Bentham consacre le plus gros de ses énergies à tenter de faire adopter par un gouvernement le principe de sa prison circulaire où le détenu est surveillé en permanence, tandis que les gardiens ont la possibilité d'observer tous les détenus. Il échoue en France, en Irlande, en Russie, en Angleterre, malgré d'importants appuis et des engagements financiers personnels, qui le mènent, lui et son frère, au bord de la ruine.

20Célibataire, solitaire, dédaigneux du faste comme du vin, retiré dans sa maison de la Queen's Square Place à Westminster, où il accueille cependant nombre de réfugiés de la Révolution française et quelques esprits curieux qui viennent examiner la maquette du panoptique et sa machinerie, Bentham n'en abandonne pas pour autant l'actualité du temps. En 1786, alors qu'il était encore au cœur de la Russie, il entend parler d'un projet de loi anglais qui viserait à restreindre la liberté des taux d'intérêt et adresse au Parlement une Defence of Usury, qui recueille quelque écho à Londres.

21En 1793, il lance un appel à la décolonisation (Emancipate your colonies) ; en 1795, proteste contre les frais de justice (A Protest against Law Taxes), puis, en 1796, prenant connaissance des "Poor Laws" de William Pitt, il se met à étudier la question de la pauvreté, mais son obsession panopticienne le reprend : il imagine un panoptique pour les asiles de bienfaisance !

22La même année, alors que la France et l'Angleterre voient leur antagonisme s'exacerber sur les terrains militaires, politiques et économiques dans le jeu de la première coalition8, Bentham se souvient de son titre de-citoyen d'honneur de la République française et se propose en médiateur entre les deux nations.

23Il intervient encore en Ecosse, à propos de l'organisation de la Justice (1807), envoie à Londres un catéchisme réformiste dans lequel, par le jeu des questions et des réponses, il propose une réforme radicale du Parlement Anglais (1817).

24Son œil réformiste scrute tous les horizons : le juridique ne le détourne pas de l'économique, ni même des questions religieuses où, là aussi, il entend juger le catéchisme de l'Eglise anglicane et discuter l'organisation ecclésiastique.

25Ce sont, cependant, les questions constitutionnelles et de codification qui captivent l'essentiel de son attention dans les années 1820-1830. En 1817, il avait adressé aux citoyens des Etats-Unis ses Lettres sur la législation (Letters on Legislation) et il correspond sur le même thème avec l'empereur de Russie.

26En 1820 et 1821, alors qu'en Espagne, Riego tente de renverser le régime absolu de Ferdinand VII, Bentham envoie conseils et recommandations aux Cortès et au peuple espagnols, quant au serment constitutionnel notamment. Il agit de même au Portugal, lorsqu'une constitution est imposée à Jean VI en 1821 et, en France, lorsqu'il s'adresse "à ses concitoyens de France", en 1830, à propos "des Chambres de pairs et des Sénats" ; en 1831, pour condamner la peine de mort.

27Le tout débouche sur un code constitutionnel, destiné à "toutes les nations professant des idées libérales", ensemble péniblement rédigé par étapes successives, en 1822, 1827 et 1830.

28Parallèlement à son attention pour l'actualité, sa propension à l'interdisciplinarité se manifeste aussi. La défense de son projet de panoptique lui cause-t-elle quelques soucis financiers. Il lance avec son frère un nouveau type de messageries rapides entre Londres et Edimbourg (1794). L'année précédente, il avait - toujours avec son frère - mis au point une sorte de "tube de conversation" expérimenté dans sa maison de Queen's Square Place.

29Comme au Queen's College d'Oxford, où dès l'âge de treize ans, il traduit les Tusculanes de Cicéron et dans le même temps s'intéresse à l'observation de la planète Vénus lors de son passage le 6 juin 1761, à l'Université, il suit tout à la fois les leçons de William Blackstone et les conférences d'astronomie et de philosophie expérimentale de Thomas Hornsby9. Etudiant, il participe à des clubs de discussion qui réunissent chimistes, architectes et métrologues. A vingt-six ans, il traduit en anglais, le Taureau blanc de Voltaire10 ; à vingt-sept, les Incas de Marmontel11 et, en 1780, De l'utilité de la chimie du suédois Bergman12, publié en latin.

30Cette interdisciplinarité, il l'applique : en 1777, les avis du chimiste et médecin Georges Fordyce13 l'intéressent dans son approche du caractère physiologique de la peine ; en 1790, il collabore avec un architecte dans le but d'illustrer une nouvelle édition du Panoptique.

31Bon harpiste, habile joueur d'échecs, Bentham manie aussi, avec adresse, l'archet et le violon. Non conformiste et original, il contribue à fonder l'University College à Londres, un établissement libre-penseur spécialisé dans les études de médecine. C'est à cette institution qu'à son décès, outre ses biens, il lègue son corps, pour qu'il soit disséqué en leçon publique, momifié, puis conservé. Démarche surprenante, qui se voulait exemplaire, dans le but de combattre les préjugés répandus à l'époque contre la dissection. Souci historique aussi d'un juriste philosophe et moralisateur, désireux de dépasser le temps ? Peut-être, puisque le corps momifié de Bentham, recouvert de ses habits d'époque et de son large couvre-chef, assis, la canne appuyée sur l'un des genoux, est aujourd'hui encore visible à l'University College, placé dans une armoire. La tête est de cire certes, mais l'original n'est pas perdu. Momifiée, pourvue encore de quelques cheveux blancs qui ont résisté au temps comme les idées qui l'habitaient jadis, elle est déposée, dressée à même le sol, aux pieds de Jeremy Bentham, mais là aussi, comme pour son interprétation par Dumont, la copie exprime davantage que l'original...
