213. « Un bon juriste a sa méthode, mais il n’en parle pas ». Faut-il croire que le juge européen fut, dès l’origine, et demeure, à l’heure actuelle, particulièrement sensible aux conseils de Rabel2. Contrastant sur ce point avec la pratique du juge communautaire ou de certains juges constitutionnels3, la jurisprudence de Strasbourg n’offre en effet pas à son observateur quelqu’ arrêt de principe, qui, s’arrachant aux tautologies, détaille de manière tant soit peu éclairante la méthode à suivre et les exigences à satisfaire pour réaliser les « justes équilibres » que le droit conventionnel — textuel et prétorien — impose en tous lieux4.
