Une préoccupation juridique essentielle chez les architectes sous l’Ancien Régime

Abstract

Although Roman law dealt with the question of building maintenance for a long time, custom, in all its variety, did the same profusely. Without seeking either the traces of medieval repairs or the numerous commentaries by lawyers on the subject, we noticed that literature dedicated to architects specifically concerned building maintenance from a legal perspective because, in the field of expertise, architects wanted to re-establish an equilibrium of knowledge with their old rivals, the masons. During the 17th century, the carpenter Pussot, the surgeon Savot, and the engineers and architects Blondel and Bullet gathered the articles concerning building maintenance – in the Reims Custom for the former, and the Paris Custom for the three others – so as to discuss and comment on the subjects of easements and repairs. Nevertheless, in his academic course, Antoine Desgodets and his followers (Lepage, Destrem, etc.) specifically and most lengthily developed this legal question.

Bien que traitée de longue date par le droit romain1, la question de l’entretien de la bâtisse2 est abondamment accueillie par la coutume avec toute la diversité qu’on lui connaît (plus de 700 coutumes sévissent en France sous l’Ancien Régime). Cependant, il convient de préciser que cette source du droit si fondamentale fait l’objet d’une série de critiques qui en ébranlent les fondements sous la forme d’une double controverse intense chez les historiens du droit. La première relativise la place de la coutume au sein du droit français face à un droit commun constitué de droit romain, ignorant de fait un aspect essentiel de la coutume, celui d’avoir été l’objet de « savoirs pratiques largement répandus »3.
