R7. Create efficient and attractive administrative and regulatory instruments to develop a deep-sea mining sector

Rationale
1To attract industrial players, it is necessary to create a credible, transparent mining department and provide clear, stable regulations (clarifying competence is not a key issue although it should, of course, be settled as soon as possible).
Timeframe
2Definition of skills and infrastructure needs should begin very early on, based on political decisions utilising the working scenarios. This work will be completed over the medium and long term.
Proposed actions
- Settle the question of the allocation of responsibilities between French Polynesia and the French State, bearing in mind that as things currently stand, the residual competence of the French State does not apply to ores identified on the Polynesian seabed.
- Document how the countries and mining territories in the region (Cook, Fiji, Papua New Guinea, Vanuatu and New Caledonia) have structured the activity, to complement this expert group review. This implies the availability of human resources to carry out the work.
- Create a clearly identifiable mining department, a one-stop shop endowed with “cross-administration” competence. An intermediary structure could handle mining policy implementation, eventually leading to the creation of an independent authority and/or a traditional mining board (based on the existing department).
- Identify infrastructure requirements in line with the choice made to develop the industry (on-site or off-site processing; see R9).
- Establish training schemes to develop the required administrative, legal, scientific or technical skills, in line with the decision to develop local talent and/or to sub-contract or pool certain functions.
Constraints and conditions
3The minimum institutional capacities needed to oversee development of the mining sector concerns the normal functions of 1) a mines department (managing mining rights, application procedures, collecting fees, etc.), 2) a geological survey (the capacity for acquiring and storing data, and promoting and supplying basic information to exploration companies) and 3) a department of the environment.

4R7 is the outcome of the definition of a deep-sea mining strategy for or by French Polynesia and the choices made for developing the sector (R3). As it is a long-term strategy, it must be monitored and evaluated (R9).
